FDA Sends Warning Letter to Juul CEO for Nicotine Vaping Promotion Tactics

The US Food and Drug Administration on Monday warned leading e-cigarette maker Juul Labs about illegally marketing its product as a safer alternative to cigarettes.

'The law is clear that, before marketing tobacco products for reduced risk, companies must demonstrate with scientific evidence that their specific product does in fact pose less risk or is less harmful, ' said Ned Sharpless, the FDA's acting head.

The FDA "also sent a letter to the company "expressing concern and requesting more information" about its outreach and marketing practices, especially to students, tribes, health insurers and employers", Jayne O'Donnell reports for USA Today.

"We remain committed to using all available tools to ensure that e-cigarettes and other tobacco products aren't being marketed or sold to kids", Sharpless said.

A spokesperson for Juul said the company intends to "fully cooperate" with regulators. The stock has a 52-week high of $66.04 and a 52-week low of $42.20.

Mr. Cuomo said he has ordered the state health department to issue emergency regulations that mandate that vape and tobacco shops post warning signs to address the increasing number of cases of respiratory illnesses and the e-cigarette youth epidemic. The FDA warning comes after the House Committee on Oversight and Reform held hearings on Juul's role in the youth nicotine epidemic in July. The letter specifically refers to Juul's "Make the Switch" campaign that conveys the idea that switching to JUUL is a safer alternative to cigarettes, in that using JUUL products poses less risk or is less harmful than cigarettes. Five deaths have been linked to vaping, and hundreds of people have been hospitalized. "Dick Durbin (D-Illinois). "People who are vaping nicotine and having these reactions probably are vaping illegal products that are counterfeit", Gottlieb said in an interview on CNBC. The agency also is responsible for the safety and security of our nation's food supply, cosmetics, dietary supplements, products that give off electronic radiation, and for regulating tobacco products.

JUUL "was much safer than cigarettes" and that "FDA would approve it any day".

"Getting to the bottom of this is a top priority for the agency and all of our federal and state partners".

And they continue to be the most used tobacco product among United States teens. "The illnesses under investigation involve the broader use of vaping products - including those being used with substances like THC; e-cigarettes are considered one type of vaping product".

The first vaping product to enter the US market was a Ruyan e-cigarette imported by Mark Weiss, founder of e-cigarette company NJOY.
