Brexit backstop legal risk 'unchanged': United Kingdom attorney general

Theresa May has secured "legally binding" changes to her Brexit deal - just hours before MPs will vote to approve the agreement in the Commons.

The problem continues to revolve around the controversial Irish backstop - the safeguard against a hard border on the island of Ireland.

"The joint instrument also gives a legal commitment that whatever replaces the backstop does not need to replicate it".

Labour leader Mr Corbyn urged MPs to vote against the deal when it returns to the Commons, saying the prime minister had "recklessly run down the clock" on negotiations. "Today, we have secured legal changes", Ms May said in Strasbourg, France.

The PM jetted to Strasbourg last night for last-minute talks with the European Union in which she says she secured "legally binding" changes. "Now is the time to come together, to back this improved Brexit deal, and to deliver on the instruction of the British people".

HuffPost UK understands the DUP can not back May's deal in light of Cox's advice, and are likely to be followed by scores of Tory Brexiteers who have said they will be guided by the Northern Irish party.

"The legal risk remains unchanged that if through no such demonstrable failure of either party, but simply because of intractable differences, that situation does arise, the United Kingdom would have, at least while the fundamental circumstances remained the same, no internationally lawful means of exiting the protocol's arrangements, save by agreement", he said.

"There should be no lingering doubts: this deal will leave us trapped and surrenders our sovereignty".

Theresa May struck a deal to revise the terms of the U.K.'s divorce from the European Union but it's unclear whether she's done enough to win Parliament's support in a crucial vote on Tuesday.

The changes fall short of demands of hardcore UK Brexiteers, but may persuade some politicians to switch their votes. But he chose to wait so his Cabinet could discuss possible progress in the Brexit process. Even with updated language on the Northern Ireland border, the vote could still fail, as most of the 585-page withdrawal agreement from January remains intact.

The agreement was resoundingly voted down in January on the issue of the "backstop" is meant to avoid a hard border between Ireland (EU state) and Northern Ireland (part of UK), but many see it as an EU ploy to keep in the United Kingdom within the customs union and the single market.
