Will Reuben Foster be welcome at 49ers offseason program?

The Santa Clara County District Attorney's Office cited for its decision to drop the ammunition charge a recent injunction issued by the U.S. District Court for the Southern District of California in San Diego, which is pending review by the U.S. Court of Appeals for the Ninth Circuit.

Foster was also charged with felony possession of an assault weapon and misdemeanor possession of a high-capacity magazine after officers found a Sig Sauer 516 short-barreled rifle in his home while investigating his girlfriend's domestic violence report. According to local prosecutors, Foster's 28-year-old girlfriend had to flag down a passing vehicle after he threw her out of his Los Gatos house.

San Francisco released a statement Thursday acknowledging the charges against Foster.

Linebacker Reuben Foster, arraigned last week on felony domestic violence and weapons charges, will not join his 49ers teammates Monday for the start of their voluntary, nine-week offseason program. He is scheduled to meet with the team this week, a sitdown that could determine his future with the franchise.

"Rueben Foster will not participate in team activities as he is tending to his legal matters".

The victim went to a hospital to be treated for her injuries and was released afterward, prosecutors said. Foster's case is more serious and could last into the regular season.

In an official statement, the district attorney's office said Foster's live-in girlfriend was bruised and suffered a ruptured eardrum.

Per the release, the alleged victim flagged down a stranger's auto following an altercation with Foster in which he physically threw her out of their home, pulled her hair and punched her in the head eight to 10 times.

After Foster was charged last week, the Niners issued a statement saying they meant to follow the matter and noted that Foster "is aware that his place in our organization is under great scrutiny and will depend on what is learned through the legal process".

According to the DA's office, the alleged victim flagged down a stranger's auto driving on Shannon Road in Los Gatos to call police.

The NFL team announced on Sunday night that the former Alabama All-American would not take part in the offseason program - at least not until Foster's legal troubles are resolved. He was named the NFL's Defensive Rookie of the Month for November and finished the season ranked second on the team in tackles (72).
