Plea to reschedule Class XII paper rejected

The Delhi High Court on Monday dismissed a plea seeking rescheduling of the re-examination of the class XII economics paper, which the Central Board of Secondary Education (CBSE) has made a decision to conduct on April 25 after the paper was leaked in March.

The court also asked CBSE to find out the reasons for the decision for not reconducting the examination and listed the plea filed by a student for April 20.

Apart from this, the bench of Acting Chief Justice Gita Mittal and Justice C. Hari Shankar, which rejected the plea, was hearing two different pleas related to the CBSE Class 10 mathematics paper.

The order came after the court was apprised by the CBSE's counsel that it has issued a notification that the Class 10 maths examination will not be re-conducted as it can not afford to hold it again and make over 16 lakh students appear in it, reported Indo-Asian News Agency.

Bench said: "Whether to hold an exam or not is for the CBSE". But he rested his case after CBSE's decision of not conducting the class 10 re-exam altogether. A bench of Justice S.A. Bobde and Justice L. Nageswara Rao said it was the "discretion of the CBSE (Central Board of Secondary Education) to conduct the re-examination and court will not interfere".

The court also heard a plea filed by Ashok Agrawal where he was seeking to get the CBSE conduct the class 10 Mathematics board exam in April. On what basis a court can say hold the exam on this day and not on that day.

The board also opposed the intervention application of the NGO saying it has considered all the aspects before scheduling the class 12th economics exam on April 25 and due care was taken while selecting the date. The decision to conduct re-examination has affected various plans of parents and students, including travel holiday plans.

During the course of proceedings, the intervener said: "It would not be in the benefit of the students to give retest in the class 12 Economics paper as there are various competitive exams going to be held on the earlier dates".
